The cross-license agreement grants both parties patent licenses to all fields for isobutanol and is structured to develop robust and sustainable isobutanol markets. The license will be royalty bearing for Butamax in certain fields and royalty bearing for Gevo in other fields. There are also a number of fields that are royalty-free for both companies. Both parties can sell up to 30 million gallons per year royalty-free into any field.

Notes:

Covers key fields of use for isobutanol. The definitive agreements more specifically define the fields of use for isobutanol.
The "lead" party will be responsible for progressing required approvals and managing the marketing and distribution of the other party's isobutanol in the respective fields.
The parties have agreed to leverage each other's regulatory approval and market development activities in order to accelerate the pace of market growth and to reduce duplication. Specifically:
Butamax will focus on gaining required approvals to support direct blending of bio-based isobutanol into on-road automotive gasoline, and is expected to market isobutanol for this application on behalf of both Butamax and Gevo.
Gevo will focus on gaining required approvals to support use of renewable ATJ made from bio-based isobutanol, and is expected to market isobutanol for this application on behalf of both Gevo and Butamax.
The licensing technology packages offered by Butamax and Gevo will differ at least as follows:
The parties will not exchange or utilize each other's proprietary microorganisms.
The parties' proprietary microorganisms will utilize different enzymes in the biobutanol pathway.
The parties' process engineering designs will include different product recovery systems.

Ik kan het nauwelijks geloven... niet de koers, dat is normaal bij GEVO, maar dat ze echt een partnerschap met Butamax hebben...

Rechtzaken voeren tegen Butamax was voor GEVO zo zeker als boterhammetjes om 12:30.

Als isobutanol maken.

Als verlies lijden (financieel).

Op het dagtaaklijstje van Brett Lund (Legal Counsel):

1. post open maken
2. post lezen
3. lunch
4. verweer tegen Butamax schrijven
5. naar rechtbank voor een uitspraak (winst!)
6. koffie, nat WC papier en smeerworst halen

Misschien heeft butamax een deal gesloten uit angst te verliezen... Maar waarom? Wat als verlies een faillissement van Gevo zou voorkomen, want er zouden tientallen miljoenen hun kant op moeten, dan zou BP en DuPont het vlees niet van Gevo's karkas kunnen trekken...?

Why doesn't BP just do a take over at this point and control everything ? Friendly or hostile....they know the future value and potential here....why not go for it all ? Taking over Gevo would be a drop in the bucket for them and Billions $$$ in future returns.....what am I missing ? Maybe their settlement had a no takeover clause ? Any ideas ? Less

With nearly $7 million in short interest and a market cap of just over $35 million it seems that the play is to try to BK Gevo now that Butamax has secured their ability to proceed with iso now with royalties. In BK the IP can be gotten for pennies on the dollar and they save billions in the long run. $$$ Less
