1. Esperite bezit patenten die door Illumina bestreden worden ;

press release that Illumina Inc. (GOLIATH) and its wholly-owned subsidiary Verinata Health Inc., have filed a patent infringement suit against us, Genoma SA, in the Federal Patent Court in Switzerland. The patents asserted are European Patent (CH) 2 183 693 B1, European Patent (CH) 0 994 963 B2, European Patent (CH) 1 981 995 B1, and European Patent (CH) 2 514 842.

The patents are directed to using cell-free fetal DNA for non-invasive prenatal testing (NIPT).

Genoma’s Directors hold a firm belief that Tranquility, a cell-free fetal DNA, non-invasive test developed by Genoma for early detection of Down syndrome, as well as other trisomies, like trisomy 13 and trisomy 18, does not infringe the patents as claimed by Illumina.

2. Een voormalig directeur van Illumina is overgelopen naar InKaryo, een Amerikaanse vestiging / tak van Esperite. Deze overspelige directeur maakt geen deel uit van de patentstrijd tussen Illumina en Esperite, maar het heeft mogelijk wel onderhuidse irritaties teweeg gebracht.

Tegen Premaitha en Genoma door illumina, een Amerikaans bedrijf. Daar is hier op dit forum al genoeg over geschreven vorig jaar.

Mijn excuus. ik had het duidelijker moeten formuleren dan 1 regel tekst, wat betrekking heeft op het net daarvoor geschrevene.

wat ik bedoel:
Als aangenomen word dat Genoma inderdaad alleen als tussenpersoon/wedeverkoper handelt en dus niet de technology zelf beheerst, waarom spant Illumina dan een rechtzaak aan tegen Esperite, aangezien men aanneemt dat ze niet de bron zijn. Illumina spant de rechtzaak aan om wille van de technology en niet de verkoop ervan...toch?

Dit zou kunnen betekenen dat Illumina dus ook een rechtzaak aan de nieuwe customer van Premaitha zal aanspannen?

naar mijn weten is bovenstaande nog niet ter sprake gekomen op het forum over de rechtzaak.

Ik heb er eigenlijk geen verstand van, maar ik denk dat de IONA-test van Premaitha hetzelfde is als de Tranquility-test van Genoma.

Genoma doet de IONA-test dan gewoon in een eigen doos met een eigen merk.

8 January 2016 - Update on competitor patent litigation

Manchester, UK – 8 January 2016 – Premaitha Health PLC (AIM: NIPT, “Premaitha” or the “Company”), developer of the IONA® test, the first CE-marked non-invasive prenatal (NIPT) in vitro diagnostic kit, notes that Illumina, Inc. has today announced two patent infringement suits in Europe, one of which is against Premaitha’s customer in Poland. Illumina has also today taken similar action against Ariosa Diagnostics, a subsidiary of Roche, and their customer, The Doctors Laboratory, in the UK.

Premaitha continues to make a robust defence against earlier claims by Illumina and the Board is confident that the IONA® test does not infringe the patents as claimed in the earlier cases or in relation to today’s announcement.

Dr Stephen Little, CEO of Premaitha said: “These lawsuits are a continuation of attempts by Illumina to restrict competition in the European NIPT market. We believe pregnant women should not be denied choice in their decisions for prenatal care. Despite these distractions, we have made strong progress with our best-in-class IONA® test. We will support our customers against such actions and we look forward to announcing new contract wins in new international territories in the near future.”

Genoma had circa 4m euros in sales in their Half Year trading results - from memory though - so the aggregate of the 10k tests alluded in the RNS should also be seen in this context. Agreed - it is quite substantial addition on top of replacing Genoma via previous RNS. The interesting thing is that they are still selling Tranquility. Potential of Middle East for NIPT is huge and estimated at US$ 1.09 Billion in 2013. Key countries within the Middle East which hold the maximum potential for NIPT are UAE, Saudi Arabia, Israel, Kuwait and Qatar according to Global Information Inc research. Smart to keep confidential names of the BBs but the interested can always look to IgBioSystems website to see what other Lab partners could be involved.

De concurentie is moordend; er zijn talloze NIPT-testen.

Bovendien lijkt het erop dat Genoma slechts een dozenschuiver is en dus testen van anderen in een eigen doos stopt en doorverkoopt.

MDx is een veel betere gok op het gebied van testen; ze vliegen daar de deur uit en zijn geheel zelf ontwikkeld.

ndividual clinicians and private clinics are offering NIPT provided by a number of different laboratories, based here and overseas. There is no ‘direct to consumer’ testing available; it must be done via a health care professional. You can find out more about the labs doing the analysis below. They all claim high detection rates but some differ in the way they analyse the cell free fetal DNA. One way to check their claims is to look at the published data* they have on their test performance. You should be able to find this on their websites.

NIPT can be performed from 10 weeks of pregnancy. Before this it is difficult to collect enough cell-free fetal DNA (cffDNA) from the blood sample. Even after 10 weeks there is a chance that they will not be able to collect enough cffDNA to provide a result. This can happen in about 3% of cases. Women who are significantly overweight have been found to be at higher risk of being in this 3%. Most providers will do a second test for free if this happens.

Results usually take 10 days to two weeks to come back from the laboratory. Remember NIPT does not give a yes/no answer for Down’s syndrome. If the result is reported as 'low risk' or very unlikely to be affected’, it is extremely unlikely that the baby has the condition. If the test result given is 'high risk' or ‘likely to be affected’ you will be offered a CVS or amniocentesis to give a definite diagnosis. It is important to realise that in this case the CVS or amniocentesis will most often confirm that the baby has Down's syndrome.

Our research suggests that costs for NIPT range from £350 to £550. If a provider is charging significantly more than £500, ask what the fee includes. Most clinics will include an ultrasound scan in the cost. If you are interested in having the test at a private clinic, make sure you check that they have a clear link with an NHS unit, so that there is a co-ordinated care pathway in place if you were to have a worrying test result.

Ik volg dit Forum al geruime tijd zonder er lid van te zijn geweest. Het aanhoudende negativisme van DZR over Esperite heeft me doen inzien dat ik met andere bril naar Amar moest kijken en uiteindelijk met een behoorlijk verlies afscheid heb genomen van mijn aandelen. Tussen de teksten van de negatievelingen en de positievelingen door zullen ook de realisten onderhand hun conclusies getrokken hebben/snel trekken. De grimmige en zeer gebrekkige (bewust of onbewust) bestuurlijke communicatie van de heer Amar heeft mij er uiteindelijk toe doen besluiten om de handel over boord te gooien. Het kan simpelweg niet zo zijn dat je je aandeelhouders zo laat zweven en constant achterlaat in onzekerheid. Of Esperite het wel of niet gaat redden zal mij inmiddels een biet wezen.

Ik ben geen activist tegen Amar en wat DZR heeft gepresteerd interesseert mij eerlijk gezegd geen fluit... Ik vind het niet langer acceptabel dat de man op zo'n gebrekkige manier, in mijn ogen respectloos, communiceert met zijn aandeelhouders. Dit standpunt heeft mij inmiddels losgeweekt van mijn overtuiging dat de markt waarin Esperite opereert zeer kansrijk is en dat Esperite daar een belangrijke rol in zou kunnen spelen. Jammer, maar mijn vertrouwen in Amar is weg.
